Statement on Reported Boycott, Intimidation and Economic Sabotage by a Section of Petroleum Re-sellers

Our attention is drawn to the ongoing boycott of petroleum products and intimidation of petroleum transporters by section of re-sellers in Nairobi and Mombasa counties resulting in fuel shortage in various parts in the Country.

The Commission has grounds to believe that the strike is spearheaded by KIPEDA HOLDINGS LIMITED, a body corporate licensed by the Commission to car...ry out Import, Export and Wholesale of Petroleum Products (Except LPG).

The Commission understands that the strike is against the implementation of the Value Added Tax Act 2013 and the Finance Act 2016 that came into effect on 1st September 2018.

The Commission therefore wishes to inform members of the public that the action by KIPEDA Holdings Limited amounts to economic sabotage and hereby cancels the licence of the said licensee pursuant to Section 85 of the Energy Act No. 12 of 2006.

KIPEDA Holdings Limited is therefore no longer licensed to carry out import, export and wholesale of petroleum products.

All ERC licensees are advised to strictly adhere to licence conditions. ^GN

ERC has today recalculated the maximum pump prices, which will be in force from 1st September 2018 - 14th September 2018 taking into account the 16% VAT.

Super Petrol will now retail at Sh 127.80 in Nairobi; Diesel Sh 115.08 and Kerosene Sh 97.41.

Pursuant to the Value Added Tax (VAT) Act of 2013 and Clause 31 of the Finance Act 2016, the VAT on Super Petrol (PMS), Diesel (AGO) and Illuminating Kerosene (IK) comes into effect on 1st September 2018.

Looking to start an LPG (cooking gas) retail business? Here are a few things you need know:

1. You need to acquire a business license from the county government.

2. You need a Fire Safety Certificate: Proof that the retail site has been assessed for conformity to approved fire safety standards. This certificate is obtained at the county government offices

3. Safety assessment report: Proof that the retail site has undertaken a safety assessment by persons registered by Directorate of Occupational Safety and Health Services.

4. Workplace Registration Certificate by Directorate of Occupational Safety and Health Services.

5. Empty or filled gas cylinders should be stored in a well-ventilated area preferably outdoors in a secured cage

6. You should only retail cylinders that have been filled by their respective brand owners. It is illegal to retail LPG in cylinders filled by people other than the brand owners Regards ^GN

Licensing of Petroleum Retail Stations

Effective 1st September 2018 all petroleum retail licenses shall be issued by ERC pursuant to Section 80 (1) of the Energy Act No. 12 of 2006.

This function has, until recently, been undertaken by Deputy County Commissioners under delegated powers stipulated in the Petroleum Rules, Petroleum Act CAP 116, Laws of Kenya.

Petroleum retail station licenses will now be applied through the online licensing portal on our website. Prior to licensing, petroleum retail stations shall be required to comply with the following Kenya Standards:

1) KS 1968:2006 - The petroleum industry - Electrical Installations in the distribution and marketing sector – Code of practice. 2) KS 1969:2013 - The petroleum industry – The installation of underground storage tanks, pumps/dispensers and pipe work at service stations and consumer installations – Code of practice. 3) KS 2506:2014 - Petroleum Facilities – Retail and consumer outlets – Specification.

ERC will award the Petroleum Retail License at no cost.

Petroleum retail station dealers who wish to be guided on the detailed licensing requirements can send enquiries through compliance@erc.go.ke ^GN

Electrical installation rules every home, business owner & electrician must know:

✓ It is the duty of the owner or occupier of any premises connected or requiring connection to electricity supply to ensure that the electrical installation work is carried out only by an electrical contractor or electrician registered and licensed by the Commission.

✓ All electrical installations must be tested and inspected periodically, any defects remedied, and appropriate certificates deta...iling particulars of the installation displayed at the point of supply.

✓ All electricians or contractors shall only use materials or apparatus tested and certified by Kenya Bureau of Standards.

✓ All the meters used or intended to be used for ascertaining the quantity of energy shall be examined and approved by the Commission.

✓ All licensees must promptly notify the Commission in writing of any accident(s) arising fromany electrical undertaking.

✓ A person SHALL NOT carry out any electrical installation work unless the person is licensed by the Commission as an electrician or an electrical contractor and that in carrying out the work, they shall adhere to the applicable laws, codes, safety and environmental protection guidelines.

✓ Electrical contractors and Electricians who issue completion certificates for works they have not done or supervised will have their licences cancelled and be prosecuted.

Failure to comply with the foregoing and any other conditions of the license or permit, ERC will not hesitate to invoke the provisions of Article 35 and 36 of the Energy Act, 2006 which may lead to imposition of penalties, suspension and/or revocation of the license or permit.

Any person who contravenes any of the provisions of the Energy Act, 2006 commits an offence and shall, on conviction, be liable to a fine not exceeding one million shillings, or to a maximum term of imprisonment of one year, or to both. ^GN

ERC Director General Pavel Oimeke yesterday appeared before The National Assembly’s Departmental Committee on Energy over the new electricity tariffs.

The Director General was accompanied by a team of experts among them Dr. Frederick Nyang Director, Economic Regulation; Cyprian Nyakundi Deputy Director, Pricing; Dr. John Mutua Deputy Director, Energy Research and Policy Analysis; and Lee Alubala Senior Renewable Energy Officer
